Today, in a significant development the Attorney General KK Venugopal made a mention before the CJI SA Bobde led bench of Supreme Court.
AG submitted that the judgment is “unprecedented” and is “likely to set a dangerous precedent”.
CJI-led bench of the Supreme Court permitted the Attorney General to file an appropriate petition against the said order.
In the meanwhile, the Supreme Court stayed the Bombay High Court’s acquittal of the accused under Section 8 of the POCSO.
Court has also issued notices to the accused.
Last week the Nagpur Bench of Bombay High Court acquitted an accused under Section 8 of POCSO Act holding that touching breast of woman without skin to skin touch is not an offence under the POCSO Act.
