Revoke Order of Permitting 100% Occupancy in Theatres: Home Ministry to Tamil Nadu Government

The Home Secretary, Ministry of Home Affairs has written a letter to the Chief Secretary of the Tamil Nadu Government.

In this letter Shri Ajay Bhalla, Home Secretary has mentioned that the Ministry of Home Affairs has vide Order dated 28 December 2020 issued guidelines for surveillance of containment of COVID 19 in India. The said order has been issued under the provision of the Disaster Management Act and is in operation till 31 January 2021. As per para 9(ii) of the guidelines cinema, theatres and multiplexes are allowed to open with 50% capacity only.

Whereas the Government of Tamil Nadu by means of a notification dated 04.01.2021 has allowed 100 occupancy in cinema, theatres and multiplexes. This amounts to dilution of the MHA Order dated 28 December 2020 issued under Disaster Management Act.

Further reference has been made to para 21 and 23 of the guidelines providing that states cannot relax the guidelines of the Central Government. In the letter a reference has been made to the order dated 18 December 2020 of the Supreme Court to the effect that the States are bound to follow the guidelines issued by the Central Government.

In view of the above it has been requested to the Tamil Nadu Government to revoke the order of allowing 100% occupancy in Theatres.
