Criminal Case For Cheating Can’t Be Initiated Merely Due To Breach Of Contract: SC

The Supreme Court has observed that a mere allegation of failure to keep a promise won’t be enough to start criminal proceedings against a person. As per the Bench of Justices Abhay S Oka and Rajesh Bindal, a breach of contract doesn’t give rise to criminal prosecution for cheating unless there is dishonest intention/fraud show
