Last week, the Calcutta High Court extended protection to an elderly couple (Senior Citizen) by directing their daughter and son in law to vacate the residential premises.
The elderly couple had told the court that the presence of the respondents posed a safety risk to them.
Hon’ble Justice Rajasekhar Mantha observed that given that petitioner number 1 was a senior citizen and was entitled under article 21 of the Indian constitution to live in peace in his own home, the court used its writ jurisdiction under article 226 and directed the Bankura Sadar Police to physically escort son and daughter I law out of the said house.
The court directed the officer in charge to ensure that respondents don’t enter the residential house without written permission and post police personnel outside the house until the next hearing date.
While disposing of the writ, Justice Mantha appreciated swift action taken by the police in ensuring the petitioners’ safety and permitted the police to take any further action as per law.
On the next date i.e. 23 June 2021, the Police department filed a compliance report also, to which the court expressed its satisfaction in restoration of possession of house to the senior citizen couple.
