Delhi Court Acquits Family in Dowry Death Case Due to Inconsistencies in Testimonies

In a significant judgment, a Delhi court has acquitted a husband, his father, and two brothers of charges related to dowry death and cruelty. The court found “material inconsistencies” in the prosecution’s witness testimonies, leading to the acquittal.

Presiding over the case, Additional Sessions Judge Vishal Pahuja examined the allegations against Gaurav, his father Sewak Ram, and brothers Sugar Shri and Saurav. They were accused of harassing Neetu, Gaurav’s wife, for dowry, which allegedly led to her suicide by hanging in February 2018. Neetu had married Gaurav in 2016, and the couple had a daughter shortly before the tragic incident.

The court noted that the prosecution primarily relied on the testimonies of Neetu’s mother and minor brother. However, these testimonies were plagued with discrepancies, contradictions, and vague allegations that failed to support the prosecution’s case or inspire confidence in their claims.

Further scrutinizing the evidence, Judge Pahuja highlighted transcripts of phone calls and chats between Neetu and her husband, as well as between Neetu and her mother, just two days before her death. The content of these communications appeared normal, lacking any mention of harassment or dowry demands. This contradiction significantly weakened the prosecution’s argument.

Judge Pahuja stated, “A cumulative consideration of the overall evidence on the facet of dowry leaves this court unconvinced about the truthfulness of the charge qua the accused persons.” He emphasized that the prosecution failed to prove the essential components of the alleged crimes beyond a reasonable doubt.
