Recently, The Punjab and Haryana HC stated that sole proprietors can be prosecuted U/Sec 138 NI Act without arraying the proprietorship firm. The bench of Justice Aman Chaudhary was dealing with the petition seeking the quashing of criminal complaint filed under Section 138 /141 of the Negotiable Instruments Act, 1881 and the consequent summoning order.
