The Delhi High Court has waived a cost imposed on petitioners in a criminal miscellaneous case, while asking their counsel to distribute samosas and tea to all employees of the Delhi High Court Bar Association (DHCBA) within one week.
Justice Saurabh Banerjee, by an order dated September 17, 2026, allowed an application filed by Indus Birra Beverages and others seeking waiver of the cost earlier imposed through an order dated August 20, 2026.
Six-Day Delay Condoned
The petitioners had also filed an application seeking condonation of a six-day delay in moving their application for waiver of the cost.
The Court noted that the petitioners sought condonation of the six-day delay in filing CRL.M.A. 28822/2026. Considering the reasons stated in the application, the Court allowed it and condoned the delay.
Cost Waived, Samosas and Tea Directed
The petitioners thereafter sought waiver of the cost imposed by the Court’s August 20 order.
Considering the factual matrix, the High Court allowed the application and waived the cost recorded in the order.
While disposing of the application, Justice Banerjee issued an unusual direction to the petitioners’ counsel.
The Court ordered:
“Learned counsel for the petitioners is called upon to distribute samosas and tea to all the employees of Delhi High Court Bar Association (DHCBA) within a period of one week.”
The application was accordingly disposed of.
