Allahabad High Court Seeks Explanation From Jhansi Judge Over Alimony For Remarried Woman

The Allahabad High Court has directed a family court judge in Jhansi to explain his decision to award monthly maintenance to a woman who had already remarried.

Justice Praveen Kumar Giri issued the order on July 7 during a hearing on a petition filed by the woman’s former husband. The petition challenges a ruling by Jhansi Family Court Additional Principal Judge Harish Chandra, who had ordered the man to pay his ex-wife Rs 10,000 per month.

The High Court has issued a formal notice to the woman and ordered Judge Chandra to submit a written explanation clarifying why the husband was directed to pay the maintenance despite the court being informed of the woman’s second marriage. The next hearing for the case is scheduled for July 21.

Details Of The Dispute

According to the petitioner’s counsel, the Jhansi Family Court officially granted the couple a divorce on July 30, 2025. Although the husband subsequently appealed the divorce decree, the woman remarried approximately one month after the court’s decision.

The husband’s legal representative stated that the woman’s second marriage was formally disclosed to the family court through a signed affidavit. Under current legal regulations, a woman is not entitled to receive financial maintenance from her former spouse following a remarriage.

Despite the filed affidavit, the family court directed the husband to pay Rs 10,000 per month to his former wife, along with Rs 5,000 per month for their son.
