The Delhi High Court has directed the Delhi Sikh Gurdwara Management Committee (DSGMC) not to alienate or create any third-party rights over its properties in Haryana and Shahdara, Delhi, as part of ongoing contempt proceedings over non-payment of teachers’ dues.
Justice Anish Dayal, presiding over the matter, also sought an undertaking from the DSGMC and Guru Harkrishan Public School (GHPS) Society that the properties will not be leased, rented, or licensed in any manner that could compromise their title or possession.
The court’s intervention follows the failure of DSGMC to pay arrears, allowances, and retiral benefits to teachers of GHPS schools in line with the Sixth and Seventh Central Pay Commission recommendations. Earlier, the court had found the committee in wilful disobedience of its previous orders.
In the order passed on May 2, the court directed, “An affidavit will accordingly be filed by the DSGMC through the secretary and the GHPS(ND) Society through its secretary, that no third-party rights will be created on this land; no alienation shall happen; and it will not be provided for any purposes of rental or license which will compromise the title or possession of the properties in any which way.”
Justice Dayal further ruled that, irrespective of the undertaking, the properties — specifically, 292 acres of land at Bigar, Haryana, and 15 acres of land at Shahdara, Delhi — must not be alienated or encumbered without prior court approval.
The court stressed the need to safeguard these high-value assets, which it noted could play a crucial role in clearing nearly ₹400 crore in outstanding dues to the petitioners. Additionally, the court ordered a valuation of the two land parcels and other DSGMC properties by a court-appointed valuer, with the report due by September 7.
