Teachers Aged 50+ Entitled to Exemption from Qualification Requirements for Promotion: Kerala High Court

In a significant judgment affecting the promotion of teachers in Kerala’s aided schools, the Kerala High Court has ruled that teachers aged 50 and above are entitled to exemption from mandatory qualification tests under Rule 45B(4) of the Kerala Education Rules (KER). The verdict, delivered by Justice Harisankar V. Menon on October 21, 2024, in the case of Laila Beegam A.R. v. State of Kerala & Others, confirmed the petitioner’s right to promotion despite incomplete test qualifications, emphasizing that age-based exemptions must be honored.

Background of the Case

The petitioner, Laila Beegam A.R., was appointed as an Upper Primary School Assistant (UPSA) in 1990 at M.M. Upper Primary School, Vadakkencherry, Palakkad. A vacancy for the Headmistress position arose on June 1, 2020, prompting Beegam to claim promotion based on seniority. She contended that she was the senior-most eligible teacher in the school, yet the school’s management appointed John Varghese, another teacher, to the post. 

Beegam had passed three of the four papers of the Accounts Test (Lower), required for promotion under the KER. However, the exam for the remaining paper, scheduled for March 28, 2020, was postponed due to the COVID-19 pandemic. Beegam argued that she was exempted from completing the test as she had turned 50 on May 2, 2016, thus falling under Rule 45B(4) of the KER, which grants test exemptions to teachers over 50.

Key Legal Issues

The case revolved around two key legal issues:

1. Seniority Calculation and Leave Without Allowance:

   The respondents argued that Beegam’s leave without allowance during 1997-98 and 1999 impacted her seniority, making her ineligible for promotion. They contended that this leave should be deducted from her total service, placing her below Varghese in seniority.

2. Eligibility for Exemption from Qualification Tests:

   The core issue was whether Beegam was entitled to test exemption under Rule 45B(4) of the KER, which allows teachers over 50 to bypass certain test requirements for promotions. Varghese, fully qualified for the position, argued that Beegam’s exemption claim was invalid in light of a Full Bench decision in WA No. 755 of 2018.

Court’s Analysis and Observations

Justice Menon clarified that leave without allowance, unless it coincided with a vacancy, does not impact seniority for promotion under the KER. Citing relevant circulars and previous judgments, he upheld Beegam’s seniority, stating:

“The period of leave without allowance availed by the petitioner cannot be deducted for calculating service seniority, as the vacancy for Headmistress arose after she resumed duty.”

Regarding the exemption from qualification tests, the court noted that Rule 45B(4) clearly exempts teachers over 50 from test requirements. The judge observed:

 “Teachers who have attained the age of 50 years shall stand exempted permanently from acquiring the qualification specified in sub-rule (1), aligning with the policy to balance experience with formal qualifications.”

The court distinguished this case from the Full Bench ruling in WA No. 755 of 2018, noting that the earlier decision applied to high school teachers under Rule 44A of the KER, not to primary school teachers under Rule 45B(4). Justice Menon emphasized that the exemption for teachers aged 50 and above remains valid and unaffected by any amendments to Rule 44A.

Verdict 

The High Court ruled in favour of Laila Beegam, stating that she was entitled to promotion as Headmistress with all consequential benefits. Since she had already reached the age of superannuation, the court did not disturb John Varghese’s appointment but highlighted that Beegam’s promotion rights should have been recognized during her service period.

Justice Menon concluded:

“The exemption under Rule 45B(4) operates irrespective of a competing claimant’s full qualifications, provided the claimant has reached the age of 50 years.”
