The Patna High Court has issued formal notices to Karnataka police and administrative authorities over allegations that two Bihar residents were taken into custody from Vaishali district without adhering to mandatory legal procedures.
A division bench comprising Justice Rajeev Ranjan Prasad and Justice Sunil Dutta Mishra, in an order dated September 3, took strict notice of the reported lapses during the inter-state operation. The bench ordered authorities from both Bihar and Karnataka to submit comprehensive affidavits detailing the justification and circumstances surrounding the detentions, the current whereabouts of the two individuals, and any judicial processes observed during the operation.
Allegations of Procedural Breaches
The judicial intervention follows a writ petition moved by Shatrudhan Prasad Singh. According to the petition, Karnataka police took Alok Ambani and Aman Kumar into custody from Vaishali on August 12.
The plea stated that visiting law enforcement personnel carried out the detentions without alerting local Bihar police. Furthermore, the petition alleged that officers transported the two men out of the state without securing a transit remand from a local court, circumventing statutory requirements for inter-state custody.
Next Court Hearing Scheduled
In response to the alleged statutory violations, the division bench mandated that both state administrations provide a full accounting of the sequence of events and clarify the legal basis under which the men were removed from Bihar.
The high court has scheduled the matter for its next hearing on September 16, when the submitted affidavits will be taken on record.
