Supreme Court Advocate On Record Association (SCAORA) wrote to Hon’ble CJI Ramana requesting him to consider and place a standardized mechanism for elevation of Advocates On Record/Advocates practising in Apex Court for elevation to the Bench of different High Courts.
The Association thanked the CJI for requesting High Court Chief Justices to consider Advocates/AOR for elevation to the High Courts in the letter.
This development comes after the Supreme Court Bar Association stated that CJI agreed to its request to consider Supreme Court lawyers for elevation to High Courts.
In its communication, the SCBA stated that despite having vast exposure to different branches of law, lawyers practising in the Supreme Court were rarely considered for elevation to the High Court. It was further stated that SC lawyers were not considered despite being more meritorious than their High Court colleagues.
However, various Bar Associations have criticized the SCBA’s move. These include Calcutta High Court Bar Association, Delhi High Court Bar Association and Andhra Pradesh High Court Bar Association, who asked the SCBA to withdraw its statements. Most Associations criticized the statement wherein it was said that lawyers practising in the Supreme Court were more meritorious than their High Court colleagues.
