SC Collegium Recommends Transfer of 4 Judges of Telangana High Court

The Supreme Court Collegium’s decision on transfer of High Court Judges are out.

The Collegium led by CJI DY Chandrachud has recommended transfer of 4 Judges of Telangana High Court.

Justice G Anupama Chakravarthy has been recommended for transfer to Patna High Court.[Read Download Recommendation]
The Collegium noted:

By a letter dated 5 August 2023 Ms Justice G Anupama Chakravarthy has conveyed her willingness to be transferred to any of the High Courts. She has, however, requested to transfer her to any High Court near to her parent High Court. We have considered the request made by Ms Justice G Anupama Chakravarthy. 

The Collegium does not find any merit in the  request made by her. The Collegium, therefore, resolves to reiterate its recommendation dated 3 August 2023 to transfer her to the High Court of Judicature at Patna.

Justice Munnuri Laxman, has been recommended for transfer to Rajasthan High Court. [Read Recommendation]

The Collegium noted:

By a letter dated 8 August 2023, Mr Justice Munnuri Laxman has requested to either postpone or drop the proposal for his transfer. In the alternative, he has sought a transfer to the High Court of Karnataka. We have considered the requests made by Mr Justice Munnuri Laxman. 

The Collegium does not find any merit in the requests  made by him. The Collegium, therefore, resolves to reiterate its recommendation dated 3 August 2023 to transfer him to the Rajasthan High Court.

Justice M Sudheer Kumar, has been recommended for transfer to Madras High Court. [Read Recommendation]

The Collegium Noted:

Mr Justice M Sudheer Kumar in a letter dated 7 August 2023 has requested the Collegium to reconsider the proposal for his transfer to the High Court at Calcutta. In the alternative, he has sought a transfer to the High Court of Andhra Pradesh, the High Court of Karnataka or the Madras High Court. 

We have carefully gone through the request made by Mr Justice M Sudheer Kumar in his above letter. While the Collegium does not  accept the request to reconsider the transfer, it resolves to recommend that he be transferred to the Madras High Court instead of the High Court at Calcutta, as proposed on 3 August 2023.

Justice C Sumalatha, has been recommended for transfer to Karnataka High Court. [Read Recommendation]

The Collegium Noted:

In her letter dated 5 August 2023 Ms Justice C Sumalatha has requested the Collegium to reconsider the proposal for her transfer and in the alternative, to consider transferring her to a High Court of a neighbouring State i.e. Andhra Pradesh and Karnataka. We have carefully gone through the requests made by Ms Justice C Sumalatha. 

The Collegium is of the view that the requests of Ms Justice C Sumalatha for reconsidering the proposal for transfer cannot be accepted. However, the Collegium accedes to her request in regard to the place to which she is being transferred and resolves to recommend that she be transferred to the High Court of Karnataka instead of the High Court of Gujarat, as proposed by the Collegium on 3 August 2023.
