SC Collegium Recommends Transfer of 3 Judges of Calcutta High Court

The Supreme Court Collegium’s decision on transfer of High Court Judges are out.

The Collegium led by CJI DY Chandrachud has recommended transfer of 3 Judges of Calcutta High Court.

These transfers are:

Justice Shekhar B Saraf has been recommended for transfer to Allahabad High Court.[Read Download Recommendation]
The Collegium noted:

By a letter dated 7 August 2023, Mr Justice Shekhar B Saraf has accepted the proposal for his transfer. He has, however, at the same time, requested for a reconsideration of the proposed transfer and in the alternative, requested to consider transferring him to any of the places i.e. Delhi, Hyderabad, Bangalore and Chandigarh. 

We have considered the requests made by Mr Justice Shekhar B Saraf. The Collegium does not find any merit in the requests made  by him. The Collegium, therefore, resolves to reiterate its recommendation dated 3 August 2023 to transfer him to the High Court of Judicature at Allahabad.

Justice Lapita Banerji, has been recommended for transfer to Punjab-Haryana High Court. [Read Recommendation]

The Collegium noted:

By a letter dated 8 August 2023 Ms Justice Lapita Banerji has conveyed her willingness to be transferred to the High Court of Punjab and Haryana. She has also requested for reconsideration of the proposal for her transfer. We have considered the request made by Ms Justice Lapita Banerji. 

The Collegium does not find any merit in the request made by her for reconsideration of the proposed transfer. The Collegium, therefore, resolves to reiterate its recommendation dated 3 August 2023 to transfer her to the High Court of Punjab and Haryana.

Justice Bibek Chaudhuri, has been recommended for transfer to Patna High Court. [Read Recommendation]

The Collegium Noted:

By a letter dated 9 August 2023, Mr Justice Bibek Chaudhuri has requested for a reconsideration of the proposal for his transfer to the High Court of Judicature at Patna. We have considered the request made by Mr Justice Bibek Chaudhuri. 

The Collegium does not find any merit in the request made by him. The Collegium, therefore, resolves to reiterate its  recommendation dated 3 August 2023 to transfer him to the High Court of Judicature at Patna.
