Justice B S Chauhan’s Visit to Allahabad HC is an Attempt to Defame UP Judiciary: HCBA Condemns Visit

Today, the Allahabad High Court Bar Association held an emergency meeting of its executive committee regarding the visit of Justice (Retd) B S Chauhan at Allahabad High Court for conducting an Inquiry against the Judges and Bar Association, in relation to Vikas Dubey case.

The Supreme Court has constituted a committee headed by Justice B S Chauhan for inquiring into the genuineness of encounter of Vikas Dubey. 

The executive of the bar association mentions in its resolution that under the garb of such inquiry Justice B S Chauhan is coming to Allahabad High Court for conducting an inquiry against the Judges of High Court, though he knows that such an inquiry is unconstitutional.

As per the resolution, such an inquiry is an attempt to defame the judiciary of Uttar Pradesh, therefore in such circumstances, it is the moral responsibility of all the lawyers to save the Judiciary otherwise the independence of Judiciary will be hampered, which is strongly opposed by the bar association.

Further the resolution says that a practicing lawyer of Allahabad High Court Late Shrikant Awasthi was sent to Naini Jail by Justice B S Chauhan, while exercising the contempt jurisdiction, where Late Shrikant Awasthi was beaten and ultimately succumbed to death. Also Late Awasthi was tied to a palang in hospital under police custody. In this regard, persons who were present at that time informed that such an action was taken on the direction and instigation of Justice B S Chauhan, which resulted into death of Late Shrikant Awasthi. Therefore the Committee has decided to publicise the inquiry report of such incident.

In view of the above circumstances the committee unanimously resolves that Allahabad High Court Bar Association strongly opposes and condemns the visit of Justice B S Chauhan on 11.01.2021 and if needed then all the lawyers of Uttar Pradesh shall prepare for an agitation, as the history of Justice B S Chauhan has always been against the lawyers.
