Identification of Victim Not Mandatory for Offence of Storing Child Pornography; Delhi High Court Sets Aside Discharge Order

The Delhi High Court has held that the identification or physical presence of a child victim is not a mandatory prerequisite for invoking Section 15(2) of the Protection of Children from Sexual Offences (POCSO) Act. The Court emphasized that for offences involving Child Sexual Abuse Material (CSAM), courts must apply the “test of subjective satisfaction”
