On 15th February 2021, the High Court of Kerala granted statutory bail to a teacher who is accused of committing sexual assault on a 10-year-old.
A 47-year-old Muhammed Kasim was working as a school teacher in the Madrassa region of Kerala. Allegedly, he repeatedly committed sexual abuse on a 10-year-old girl from the period of July 2019 to March 2020. He was finally arrested in December 2020 under Secs.354, 354(A) (1) (i) of IPC, Sec.8 read with sec.7 and Sec.10 read with sec.9 (l), (m), (f) of the Protection of Children from Sexual Offences (POCSO) Act, and Sec.75 of the Juvenile Justice Act.
The Counsel for the petitioner submitted that the petitioner has been in custody from 11th December 2020 and the final report has still not been filed. Hence, he was entitled to statutory bail under Sec.167 of Cr.P.C. The same was stated by the Public Prosecutor.
Judge P. V. Kunhikrishnan granted statutory bail to the accused, on a bond of Rs.50, 000 and outlined certain bail conditions.
