Delhi High Court Rejects Bail for Man Accused of Murdering Lover’s Husband

The Delhi High Court has refused to grant bail to a man charged with the murder of his lover’s husband, emphasizing the severity and brutal nature of the crime. The accused allegedly killed the victim by pushing him in front of a moving train in 2019, resulting in a particularly gruesome death.

Justice Subramonium Prasad, presiding over the case, cited the heinous nature of the crime as a decisive factor in the bail denial. “There are reasonable grounds to believe that the petitioner has committed the offence,” Justice Prasad stated, pointing out the likelihood of a severe sentence, possibly life imprisonment or the death penalty, if the accused is convicted.

Despite the accused having been in custody since 2019, the court noted that significant progress had been made in the trial, with most witnesses already examined. However, given the nature of the crime and the manner in which it was executed, the judge found it inappropriate to release the accused on bail at this stage.

According to the prosecution’s narrative, the accused lured the victim to a deserted road near a railway line under the pretext of meeting him, attacked him with a brick, and then pushed him onto the tracks where he was struck by a train and bisected. This gruesome act was initially reported to the victim’s family as an accident, an attempt by the accused to mislead both the family and the police.

The defense argued that the case was based on circumstantial evidence and claimed that the accused was falsely implicated. Nonetheless, the court concluded that the evidence and witness testimonies suggest the accused’s involvement in the crime.

“The material on record discloses that the petitioner won the confidence of the deceased, despite being in love with his wife. He then committed the crime in a very brutal manner and initially tried to portray it as an accident,” the court observed in its judgment.
