Delhi HC Orders AIIMS Director to Implement Health Reforms Amid Departmental Strife

In a significant intervention aimed at addressing the ongoing discord within the health department, the Delhi High Court on Monday assigned the AIIMS director the task of implementing hospital reforms. This directive comes in response to unsettling reports of a “bitter” fight between the health authorities in the capital.

The court’s decision was prompted by a letter from Dr. S K Sarin, head of a six-member expert committee, which suggested that the committee be excused from overseeing the reform implementations due to perceived threats and challenges faced by its members, four of whom are senior doctors at government hospitals.

Acting Chief Justice Manmohan, leading the bench, expressed concern over the lack of unity and the prevailing “toxic” environment among health officials. He noted, “The common man is the ultimate victim of apathy and indifference at the hands of those who are responsible.”

In a troubling revelation, the court also took notice of a separate but severe allegation involving a party worker accused in the rape-murder of a doctor at Kolkata’s RG Kar Medical College and Hospital, highlighting the intense and fearful atmosphere among senior health professionals.

“Extraordinary situations call for extraordinary measures,” the court declared, mandating the director of AIIMS to ensure that the recommendations of the Dr. Sarin committee are implemented earnestly. The court also ordered the renewal of services for the four member doctors for two years while ensuring their protection from harassment.

The directive has stirred some controversy, especially given AIIMS’ association with the central government, which adds a political dimension to the court’s decision. Despite reservations expressed by Delhi government’s senior counsel about involving the AIIMS director, Justice Manmohan emphasized the need to keep politics out of critical health reforms.

Further directives included a mandate for a meeting among city authorities to discuss the staffing of 24 upcoming hospitals in Delhi. This meeting, suggested to include high-ranking officials such as the lieutenant governor and health minister, aims to address the creation of new medical posts.

The AIIMS director has been given broad authority to take necessary steps for implementing the committee’s suggestions, which include forming teams, raising funds, and procuring medical equipment. A comprehensive report from the director is expected in the proceedings.
