COVID Can’t Be Retrospective: HC Quashes FIR Against Man For Breaching Quarantine Protocols

Recently, Justice Mukta Gupta of the Delhi High Court observed that a man who arrived in India before Covid guidelines were implemented can’t be prosecuted as restrictions cannot be imposed retrospectively. The Court further said that the genesis of the prosecution’s case was faulty. The police had booked the man u/s 188 of the IPC
