Bail granted to a person accused of assaulting a Girl for refusing to marry him

The Calcutta HC on Friday released a person on bail who was convicted under Section 326 /307 of the Indian Penal Code. According to the prosecution story, a married lady was seriously injured by the appellant. The married lady and the appellant were in a love affair.

The appellant insisted the victim lady to marry him leaving her husband. The said proposal was not accepted by the victim. Therefore, the accused assaulted her with grievous injury with the intention to commit her murder. Consequently, he was convicted by the learned sessions court.

The HC while granting bail to the appellant observed that the appellant suffered term imprisonment for five years for committing an offense under Section 307 of the Indian Penal Code. He was all along on bail during the trial. Therefore it would be appropriate to enlarge the appellant on bail during the pendency of the appellant.
