The Apex Court refused to apply a dictum of automatic vacation of stay as stated in the Apex Court judgment of Asia Resurfacing case, in a case where the High Court had passed an order in writ proceedings. In the instant case, the High Court Division Bench had stayed the order of a Single Bench.
