Allahabad High Court Directs State Election Commission to Finalize UP Panchayat Poll Schedule

The Allahabad High Court has mandated the Uttar Pradesh State Election Commission to bring the complete timeline for the upcoming panchayat elections on record, emphasizing the constitutional requirement to conclude the process before the current tenure expires.

In a significant move toward ensuring timely local governance elections, the Allahabad High Court has ordered the Uttar Pradesh State Election Commission (SEC) to finalize and present a detailed, time-bound schedule for the state’s panchayat elections. The court emphasized that the election process should ideally align with the mandate of Article 243E of the Constitution of India.

The order was passed by a two-judge bench comprising Justice Ajit Kumar and Justice Indrajit Shukla while hearing a writ petition seeking a direction to the SEC to produce the election schedule.

The matter came to light during a hearing on Monday when the petitioner’s counsel informed the bench that a similar petition, filed earlier by one Imtiaz Husain, was already pending before the court with a scheduled hearing date of April 30.

Recognizing the identical nature of the relief sought in both matters—specifically the demand for a transparent and fixed timeline for the panchayat polls—the court ordered the current petition to be connected with the earlier filing.

The core of the legal challenge rests on Article 243E of the Constitution of India, which stipulates that elections to constitute a Panchayat must be completed before the expiry of its five-year duration. In the case of the current district panchayats in Uttar Pradesh, this constitutional deadline is set for May 26.

Previously, during the hearing of Imtiaz Husain’s petition, the High Court had directed the State Election Commission to file an affidavit. The commission was asked to clarify whether it is in a position to conclude the entire election process by the May 26 deadline to satisfy the constitutional mandate.

The petitioners moved the court expressing concern over the lack of a clear roadmap as the expiry of the current tenure draws near. They argued that a detailed schedule is necessary to ensure the democratic process is not delayed.

Directing the SEC to act promptly, the court observed:

“It is expected from respondent No.2 (state election commission) that the entire schedule of holding the election should be finalised and brought on record before the next date of listing.”

The court’s directive places the onus on the SEC to provide a clear, step-by-step timeline for the various phases of the panchayat elections during the next hearing.
