Allahabad HC Directs MP-MLA Court to Hear Nawab Kazim Ali Khan in Azam Khan’s Sentence Enhancement Appeal

The Allahabad High Court has directed the Special Judge of the MP-MLA Court in Rampur to permit Nawab Kazim Ali Khan, also known as Naved Miyan, to participate in the proceedings regarding the enhancement of Azam Khan’s sentence. The order, passed by Justice Vikram D. Chauhan, comes as the state government seeks a stiffer penalty for the Samajwadi Party leader following his conviction on November 17, 2025.

The matter reached the High Court after Nawab Kazim Ali Khan challenged a previous ruling by the Rampur MP-MLA court. Naved Miyan had originally filed a revision petition seeking an enhancement of the punishment awarded to Azam Khan. However, the lower court dismissed his plea, reasoning that since the Uttar Pradesh government had already lodged its own appeal for a sentence enhancement, a separate revision plea by the complainant was not maintainable.

Seeking to assert his right to be heard as the original complainant, Khan moved the High Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

During the proceedings before Justice Chauhan, a consensus was reached between the legal representatives of the involved parties. It was agreed that the revisionist-complainant should be allowed to participate in the state’s appeal currently pending before the sessions court.

The High Court noted the agreement, stating:

“In view of the agreement entered between the parties, the present application under section 528, BNSS, is disposed of with a direction to the court of Special Judge (MP/MLA)/Additional Sessions Judge, Rampur, to hear the present revisionist — Nawab Kazim Ali Khan alias Naved Miyan — in the appeal filed by the State.”

The direction ensures that the complainant’s perspective will be officially considered during the state’s appeal process. The Uttar Pradesh government is currently challenging the November 2025 conviction order, arguing that the punishment awarded to Azam Khan was insufficient and should be increased.

With this High Court intervention, the Rampur court is now mandated to hear Nawab Kazim Ali Khan’s arguments as part of the ongoing judicial review of the sentencing.
