Affidavit of Mother of Gang Rape Victim Proved to be False: ALL HC

On 15.10.2020, the Allahabad High Court, directed the Police Officials to produce the Gang Rape Victim before the Court. 

This Order was passed on the Petition of mother of rape victim. 

She alleged that her daughter has been detained in the Police Station.

It was further stated that the police is not permitting the family members of the petitioner to meet the girl (victim).

In pursuance of the direction of the High Court, the SSP, Prayagraj filed his personal affidavit.

A personal affidavit was also filed by Smt. Kunti, mother of the girl (victim). 

On 21.10.2020, the girl (alleged victim) was produced before the Court. 

She stated before the court that she was never detained by the Police Authority. 

So, the affidavit filed by the mother of the victim girl appeared to be false. 

Considering the fact that the mother of the girl (victim) appears to be a poor, illiterate, helpless villager, the court took lenient view. 

The Court only warned her against recurrence of similar conduct in future.

Action For Delay in Lodging FIR

However, the High Court took serious view of the matter in delay in lodging of FIR. Court noted that Sub Inspector Pramod Kumar, Police Station Phoolpur and Inspector Brijesh Kumar, the then Station House Officer, Phoolpur have been suspended by SSP.

The Court observed that there is gross negligence and laxity on the part of the Police Department. Further the court said that this is highly deprecated and such gross negligence. 

Hon’ble Judges called said that it so ‘callousness’, is unbecoming of the conduct of a responsible officer entrusted with the obligation of performing the duties of a Public Office. 

Considering the facts of the case the Court directed the SSP to provide proper protection to the victim girl as well as her family members.
