Live-in Relationship with a Married Person is not tenable in law: Rajasthan HC

The Rajasthan High Court has held that a live-in relationship between an unmarried person and a married person is untenable in law.

Hon’ble Justice Pankaj Bhandari gave this order in a petition filed by a woman who sought the protection of her liberty and life as she got threats for living with a married man.

While dismissing the plea, the Bench stated that the prerequisites of a live-in relationship as held by the Top Court in D Velusamy vs D Patchaiammal was that the couple must be like spouses in the society and must be of legal marriage age or qualified to enter legal marriage.

Recently, the Punjab & Haryana High Court refused to grant protection to two sets of couples and ruled that live-in relationships were socially and morally unacceptable and could disturb society. 

One of the couples moved to Apex Court, which directed the Punjab Police to protect the couple.
