SARFAESI | Sale Notice Issued Without 15 Days’ Clear notice is bad in law: Kerala HC

Recently, the Kerala High Court ruled that three methods of serving, affixing, and publishing a 15 days notice for subsequent sale as given under Rule 9(1) of Security Interest (Enforcement) Rules are mandatory and can’t be tampered with. The Bench of Justice Bechu Kurian Thomas quashed the sale notice issued under the Securitisation and Reconstruction
