Calcutta High Court Grants Pre-Arrest Bail to Primary School Teacher Accused in Assault Case

The Calcutta High Court has approved anticipatory bail for a primary school teacher facing allegations of pushing a disabled child and attacking the child’s mother with a knife.

Justice Md Shabbar Rashidi issued the order on August 20, granting protection from arrest on the grounds that the petitioner is a working professional. Under the relief conditions, the Belda-posted educator must furnish a bail bond of Rs 10,000 along with two sureties of equal value to the satisfaction of the arresting officer. She has been instructed to fully assist investigators and is prohibited from entering the territorial jurisdiction where the alleged offenses occurred.

Allegations and Criminal Charges

The matter stems from an incident at the home of the teacher’s maternal grandmother, where the complainant’s family was reading alongside the grandmother. According to court records, the accused and her husband had a history of causing disturbances for the complainant’s family. During the encounter, the teacher reportedly knocked the complainant’s disabled daughter to the ground and subsequently assaulted the mother with a knife after she raised objections.

Police registered a case against the educator involving provisions of the Bharatiya Nyaya Sanhita (BNS), 2023. The charges against her encompass house trespass, criminal intimidation, causing hurt, and employing criminal force or assault against a woman.

Court Arguments and Case Findings

During the hearing, defense attorney Tapas Kr Dey pointed out that despite allegations involving a knife attack, the official case diary contained no injury report to indicate physical harm.

Representing the opposition, attorneys Biswajit Tiwari and Anirban Kumar Banerjee highlighted that the co-accused husband remains at large. They directed the bench to evidence in the case diary, including witness testimony taken under Section 180 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) and the complainant’s statement recorded under Section 183 of the BNSS.
