The Uttarakhand High Court has instructed the Dehradun District Magistrate to examine an Indian citizenship application submitted by a Tibetan national and take necessary legal action within six months.
A single-judge bench of Justice Manoj Kumar Tiwari directed local officials to review the application along with all attached documentation. Should the scrutiny confirm that the submission meets all statutory criteria, the district magistrate must forward the case files to the competent authority of the Central government within six weeks of receiving a certified copy of the order.
Delays In Processing Petition
The decision follows a writ petition filed by Tenzin Thinley, who sought judicial intervention after the Dehradun District Magistrate’s office failed to transmit his citizenship request to federal authorities. Thinley had submitted his application under the Citizenship Act of 1955, but the administrative process remained stalled at the district level without being forwarded to the Central government.
In his plea, Thinley requested the court to direct the local authorities to transmit his application to the central body and take appropriate steps toward granting citizenship. He also asked the court to summon all administrative records pertaining to his case.
Background And Timeline
Information presented during the proceedings indicated that Thinley was born on September 15, 1992, and entered India from Tibet on May 12, 2013. The court’s order establishes a clear timeframe for the local administration to complete its examination and ensure the application moves forward according to statutory procedures.
