BJP Legal Cell Urges Calcutta High Court to Defer Adverse Orders Against West Bengal Government Amid Power Shift

In a significant legal development following the assembly election results, lawyers associated with the Bharatiya Janata Party (BJP) legal cell made a verbal appeal before the Calcutta High Court on Tuesday, requesting a temporary freeze on any adverse orders against the West Bengal state administration. The plea cites the ongoing transition of power as the incoming BJP government prepares to take office.

The request was raised by a team of advocates, including Rajdeep Majumdar, Dhiraj Trivedi, and Susmita Saha Dutta, across various courtrooms within the High Court. The lawyers urged the bench to refrain from issuing any directions that could negatively impact the state for a period of a few days, arguing that the new dispensation needs time to settle in and assume administrative responsibilities.

The legal move follows a landmark shift in West Bengal’s political landscape. The BJP secured a decisive victory in the 294-member assembly, winning 207 seats. This result effectively ends the 15-year uninterrupted tenure of the Trinamool Congress (TMC) in the state.

Given the scale of the administrative overhaul accompanying such a change in government, the BJP’s legal representatives argued that immediate adverse judicial orders could complicate the handover process.

Advocate Susmita Saha Dutta, who mentioned the matter before the Chief Justice’s court, stated that the request was acknowledged by the bench. Chief Justice Sujoy Paul reportedly noted the verbal plea and indicated that the court would take the request into consideration while handling state-related matters in the coming days.

The advocates emphasized that the temporary reprieve is necessary to ensure that the incoming administration can properly represent the state’s interests and respond to ongoing legal challenges once the transition is complete.
