J&K High Court to Continue Hearing on AAP MLA Mehraj Malik’s PSA Detention on Feb 12

The High Court of Jammu and Kashmir and Ladakh will continue hearing the matter concerning the detention of Aam Aadmi Party (AAP) MLA Mehraj Malik under the Jammu and Kashmir Public Safety Act (PSA) on February 12, 2026.

Justice Mohammad Yousuf part-heard the arguments advanced on behalf of the Jammu and Kashmir administration on Thursday and posted the case for further hearing next Monday.

Malik, who represents the Doda constituency, was arrested in September 2025 under the stringent preventive detention law. His party, the AAP, has challenged the legality of the detention order before the High Court.

Speaking to PTI, AAP spokesperson Mudasir Hassan confirmed the development and reiterated the party’s position that Malik’s detention is politically motivated and unconstitutional.

The PSA allows for detention without formal charge or trial for up to two years in certain cases and has often faced criticism from civil rights groups for its potential for misuse. The outcome of the present case may have significant implications for political dissent and preventive detention jurisprudence in the region.

Further arguments from the Union Territory administration are scheduled to be heard on February 12.
