“Tu Hai Kya Cheez… Bahar Mil, Dekhte Hain Kaise Zinda Ghar Jaati Hai”: Accused and Lawyer Threaten Female Judge in Open Court After Conviction

A Delhi court has convicted the accused Raj Singh in a case under Section 138 of the Negotiable Instruments Act, 1881, filed by M/s Vintage Credit and Leasing Pvt. Ltd., while also recording a serious incident of courtroom misconduct following the pronouncement of judgment.

The matter, registered as Ct. Cases 18139/2019, had been pending for over five years. On April 2, 2025, Judicial Magistrate First Class (NI Act)-05, Shivangi Mangla, pronounced the judgment convicting the accused Raj Singh for issuing a dishonoured cheque, in violation of Section 138 NI Act.

According to the order dated April 2, 2025, after hearing the judgment, the accused “erupted with anger” and began harassing the presiding judge in open court. The order states that the accused made abusive remarks in unofficial Hindi, including commentary involving the judge’s mother, and attempted to throw an object at the judge. He also instructed his advocate, Sh. Atul Kumar, to “do anything to get judgment in his favor.”

The judge further recorded that both the accused and his counsel continued their harassment, making threats such as:

“tu hai kya cheez ………….ki tu bahar mil dekhte hai kaise zinda ghar jaati hai……..”

They allegedly pressured the judge to resign and threatened to file false complaints unless the judgment was changed to an acquittal. The judge stated:

“Still the undersigned stand against all the odds and always do needful in favor of justice.”

The judge noted the intention to take appropriate action before the National Commission for Women, Delhi, in response to the threats and harassment faced.

In light of the misconduct, the court issued notice to the accused’s counsel, Sh. Atul Kumar, to provide a written explanation for his conduct and to show cause why criminal contempt proceedings should not be initiated against him. The court also directed the accused to furnish bail bonds under Section 437A of the Code of Criminal Procedure.
