Supreme Court Collegium Recommends Elevation of Justice Joymala Bagchi of Calcutta High Court to Supreme Court- Will be CJI in 2031

In a significant development, the Supreme Court Collegium has recommended the elevation of Justice Joymalya Bagchi, currently serving at the Calcutta High Court, to the Supreme Court of India. This decision underscores Justice Bagchi’s distinguished judicial career and his contributions to the Indian judiciary.

Collegium noted:

After the retirement of Mr. Justice Altamas Kabir on 18th July 2013 as Chief Justice of India, there has not been any Chief Justice of India from the High Court at Calcutta. On the retirement of Mr. Justice K.V. Viswanathan on 25th May 2031, Mr. Justice Joymalya Bagchi would be in line to assume office as the Chief Justice of India till his retirement on 02nd October 2031. Mr. Justice Joymalya Bagchi would have a tenure of more than six years before he assumes the office of the Chief Justice of India.

The Collegium has also taken into consideration the fact that, at present, the Bench of the Supreme Court is represented by only one Judge from the High Court at Calcutta. Mr. Justice Joymalya Bagchi stands at Sl.
No. 11 in the combined all-India seniority of High Court Judges, including Chief Justices.

The Collegium has, therefore, unanimously resolved to recommend that Mr. Justice Joymalya Bagchi be appointed as a Judge of the Supreme Court of India.

Justice Bagchi commenced his legal journey in 1991, practicing predominantly in the Calcutta High Court. Over the years, he established himself as a prominent advocate, handling numerous cases related to criminal and constitutional law across various high courts and the Supreme Court. His advocacy in high-profile cases, such as opposing the ban on the book ‘Dwikhondito’ by Bangladeshi author Taslima Nasreen, highlighted his commitment to civil liberties and freedom of expression.

In June 2011, Justice Bagchi was appointed as a judge of the Calcutta High Court, marking the beginning of his judicial tenure. In December 2020, the Supreme Court Collegium recommended his transfer to the Andhra Pradesh High Court, a move that was implemented in early 2021. However, by September 2021, the Collegium decided to re-transfer him to his parent High Court in Calcutta, reflecting their continued confidence in his judicial capabilities.

During his tenure at the Calcutta High Court, Justice Bagchi presided over several notable cases. He emphasized the importance of swift trials in matters concerning financial irregularities to maintain public trust in the judiciary. Additionally, he played a pivotal role in addressing issues related to civil liberties, environmental protection, and human rights, showcasing his dedication to upholding the rule of law.

The Supreme Court Collegium’s recommendation for his elevation is a testament to his extensive experience, legal acumen, and unwavering commitment to justice. As a Supreme Court judge, Justice Bagchi is expected to contribute significantly to the nation’s jurisprudence, bringing his vast expertise and principled approach to the highest court of the land.
