In a bid to streamline court proceedings and save judicial time, Chief Justice of India, Sanjiv Khanna, has urged lawyers to submit advance letters for the withdrawal of cases. The recommendation was made during a court session on November 27, where a transfer petition in a family matter was withdrawn following the parties’ reconciliation.
Chief Justice Khanna emphasized the efficiency of this practice, stating, “If you have any such requests, you can always give a letter to the Court Master, one day in advance or two days in advance. That will help us resolve the matter or not read the files. Whenever you have a request for withdrawal, you can always submit it.”
The move comes in the wake of discussions at the Constitution Day Function, where the Chief Justice addressed the legal community’s request to revert to the previous system of circulating adjournment letters, a suggestion he declined. By advocating for pre-submitted withdrawal letters, Chief Justice Khanna aims to reduce unnecessary reading and deliberation on settled or moot cases, thereby aiding in the smoother functioning of the judiciary.
