The Delhi High Court has issued notices to several bodies including the Delhi government and the Delhi Waqf Board following a plea that highlights alleged unauthorized constructions at a graveyard on Idgah Road. The complaint accuses the Waqf Board of remaining silent over the purported illegal activities.
A bench comprising Acting Chief Justice Manmohan and Justice Tushar Rao Gedela has called for a detailed response from the Delhi Government, Delhi Waqf Board, Municipal Corporation of Delhi, and Delhi Police regarding the allegations. They have been given four weeks to file their replies, with the matter set to be revisited in court on November 11.
The court also imposed an interim order to maintain the status quo concerning the property’s title and specified that any ongoing construction must halt pending further judicial review.
The petitioner, Mohammad Mazhar Ahmed, asserts that the Qabristan Ahata Badruddin, a recognized waqf property, has been compromised through fraudulent transactions leading to illegal construction and desecration of graves. Represented by advocate M Sufian Siddiqui, Ahmed claims these actions breach specific regulations under the Waqf Act and the Bharatiya Nyaya Sanhita, posing serious questions about the protection and management of waqf properties.
