Supreme Court Stays Divorce Granted to Chef Kunal Kapur on Grounds of Cruelty

The Supreme Court has temporarily halted the divorce decree issued to celebrity chef Kunal Kapur by the Delhi High Court, which had found him to be a victim of cruelty by his estranged wife. The case has now been referred to the Supreme Court Mediation Centre to assess the potential for a reconciliatory settlement between the parties.

Justices Hrishikesh Roy and S.V.N. Bhatti, presiding over the matter, issued a notice to Kapur following an appeal from his wife, challenging the High Court’s decision. The High Court had previously overturned a family court’s ruling that denied Kapur a divorce, declaring that public defamatory and unsubstantiated allegations by a spouse constitute cruelty under the law.

The High Court had detailed that Kapur’s wifeโ€™s behavior lacked dignity and empathy, severely impacting the sanctity and essence of their marriage. “When such is the nature of one spouse towards the other, it brings disgrace to the very essence of marriage and there exists no possible reason as to why he should be compelled to live while enduring the agony of living together,” the High Court had expressed.

Kunal Kapur, known for his role as a judge on the television show “MasterChef India,” had married in April 2008, and the couple has a son born in 2012. In his plea, Kapur cited continuous disrespect and humiliation towards him and his parents by his wife. Conversely, his wife has accused him of fabricating stories to mislead the court, asserting that she has always attempted to maintain a loving and loyal relationship.
