Jharkhand High Court Puts a Hold on Reservations in Promotions, Directs Government to Follow Supreme Court Guidelines

In a significant ruling, the Jharkhand High Court, led by Acting Chief Justice S. Chandrashekhar and Justice Navneet Kumar, has issued a stay on reservations in promotions. The decision came after a petition was filed against the Jharkhand government’s resolution dated March 31, 2003, challenging its validity on the grounds of non-compliance with Supreme Court guidelines.

The bench stated that until a new set of rules is formulated in the light of the Supreme Court’s judgments in the Jarnail Singh and M. Nagaraj cases, the Jharkhand government cannot grant reservations in promotions. This ruling underscores the necessity of adhering to the Supreme Court’s directives, ensuring that guidelines related to reservation policies are followed meticulously.

The petitioner argued that the Jharkhand government’s resolution was flawed and failed to adhere to the guidelines laid down by the Supreme Court. In response, the High Court has held that the 2003 resolution will not be effective until new rules, guidelines, and executive instructions are established according to the Supreme Court’s judgments.

Furthermore, the court highlighted a specific case from the Road Construction Department where Scheduled Tribe (ST) and Scheduled Caste (SC) category Junior Engineers (JEs) were promoted to Assistant Engineers in 2023. This promotion did not extend to the general category, leading to the filing of a writ petition against the government’s decision.
