Whether Order XXIII Rule 1(4) CPC Applies to Application U/s 34 of Arbitration Act? Answers Patna HC

The Patna High Court has ruled that a challenge to an arbitral award filed under Section 34 of the Arbitration and Conciliation Act, 1996 is not a suit. As a result, the provisions of Order XXIII Rule 1(4) of the Civil Procedure Code, 1908 relating to withdrawal of suit are inapplicable.  Justice Anil Kumar Sinha
