In a recent ruling, the Uttarakhand High Court has declined to stay the arrest of Mukesh Singh Bora, the president of the Nainital Milk Federation, who is accused of raping a widow employee. Justice Vivek Bharti Sharma presided over the case and rejected the petition after reserving the decision this past Tuesday.
Mukesh Singh Bora, who sought a stay on his arrest through the High Court, is alleged to have committed the crime under the pretext of offering the victim a permanent position at the federation. Following these allegations, he also faces accusations of molesting the victim’s daughter, prompting a case under the Protection of Children from Sexual Offences (POCSO) Act at the Lalkuan police station.
The court emphasized the severity of the charges against Bora, noting that an individual accused of such heinous crimes poses a risk of obstructing the investigation and tampering with evidence. On these grounds, the bench determined that Bora is not entitled to any interim relief, leading to the dismissal of his petition.
This decision follows a previous ruling on September 13 by another bench led by senior High Court judge Manoj Kumar Tiwari, which temporarily stayed Bora’s arrest. However, the matter was set to be revisited on September 17 by Justice Sharma’s bench.
In the interim, the High Court has mandated that Bora cooperate fully with the ongoing investigation. It has also instructed him to report daily to the Almora police station and barred him from entering Nainital until further hearings.
