The Supreme Court has transferred the rival trademark suits between M/s The Supreme Industries Limited and M/s Supremo India Private Limited, pending in Delhi and Indore, to the City Civil Court, Ahmedabad, so that both can be tried before one court.
A Bench of Justice S.V.N. Bhatti and Justice N.V. Anjaria disposed of two cross transfer petitions filed by the companies, each seeking to move the other’s suit to the forum where it had sued.
The Two Suits
Supremo India filed CS (Comm) No. 134 of 2025 before the District Judge (Commercial), Indore. It sought a permanent injunction restraining Supreme Industries from using the trademark ‘SUPREME’, removal of the impugned goods from e-commerce platforms, disclosure of assets and damages of ₹15 lakh.
Supreme Industries filed CS (Comm) No. 1294 of 2025 before the Delhi High Court. It sought injunctions against trademark infringement, passing off, copyright infringement in the ‘SUPREME’ label and logo, and dilution of its mark. It also sought rendition of accounts, destruction of infringing products, damages of ₹2,00,01,000 and a declaration of ‘SUPREME’ as a well-known mark under Section 2(1)(zg) of the Trade Marks Act, 1999.
Supreme Industries asked the Supreme Court to transfer the Indore suit to New Delhi, while Supremo India sought transfer of the Delhi suit to Indore.
Court’s Reasoning
The Court heard Senior Counsel Neeraj Kishan Kaul and S. Janani for the parties. It noted that each side insisted the other’s suit be moved to its own chosen forum, while opposing the place where the opposite party had sued. The Bench recorded:
“The Counsel are at least in ad idem that both matters be tried before one Court.”
It added that counsel had left it to the Court to transfer both suits to one particular court. The Bench clarified that it was not referring to some of the contentions raised and was not expressing any view on the merits.
Outcome
Exercising its jurisdiction and discretion, the Court transferred both suits to the City Civil Court, Ahmedabad. The Indore court and the Delhi High Court were directed to send the respective plaints to Ahmedabad expeditiously. The parties have been directed to appear before the City Civil Court, Ahmedabad on 26.11.2026.
