Supreme Court Clears Path for Trial in Gurugram Child Rape Case; SIT Investigation Complete

The Supreme Court on Monday authorized the filing of a final investigation report before a Gurugram court in the case of a horrific sexual assault of a three-year-old girl. While the Special Investigation Team (SIT) has concluded its probe into the crime itself, the apex court has kept the matter pending to scrutinize the conduct of government doctors and the adequacy of victim compensation.

A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi gave the green light for the SIT to submit its findings through the jurisdictional police station to a designated woman POCSO judge in Gurugram. This follows a court-ordered investigation led by three senior women IPS officers: ADGP Kala Ramachandran, SP Dr. Anshu Singla, and DCP Jasleen Kaur.

The bench recorded its appreciation for the SIT, noting that the officers completed their task within the court-mandated timeframe. To ensure a sensitive trial environment, the Supreme Court specifically directed the Gurugram District and Sessions Judge to assign the case to a special POCSO court presided over by a female judicial officer.

The intervention of the Supreme Court was triggered by what it previously described as a “shameful,” “reckless,” and “insensitive” approach by the Haryana Police and the local Child Welfare Committee.

During earlier proceedings, the court had slammed the state authorities, stating, “Shame on you! Is this the way the state deals with crime? The child has undergone more horrifying repeated experiences than the crime itself.”

The apex court observed that investigations ranging from the level of the Commissioner of Police down to the Sub-Inspector suggested a “concerted and unwarranted attempt” to discredit the three-year-old victim. The court noted that the initial police response appeared designed to portray the parents’ concerns as “exaggerated and unfounded” rather than pursuing justice.

While the criminal trial is now set to proceed, the Supreme Court has not disposed of the victim’s father’s petition. The court intends to examine:

  1. The Role of Medical Professionals: Specifically, the conduct and response of doctors at government hospitals who handled the minor following the discovery of the crime.
  2. Victim Compensation: Ensuring that the grant of compensation is appropriate and timely for the victim’s recovery and rehabilitation.

The minor was allegedly subjected to repeated sexual assault over a period of two months (between December 2025 and January 2026) at a residential society in Gurugram’s Sector 54. The accused include two female domestic helps and a male accomplice.

An FIR was registered on February 4 at the Sector 53 police station under the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children from Sexual Offences (POCSO) Act after the child disclosed the ordeal to her mother.
