Section 127A of the RP Act is a Non-Cognizable Offence, Therefore Magistrate’s Permission is Mandatory for a Police Investigation: Karnataka HC

Karnataka HC has ruled that offence u.s 127A of Representation of People Act is a non-cognisable offence therefore Magistrate’s permission in terms of 155 CrPC is necessary for a police investigation. The Bench of Justice S Sunil Dutt made these observations while allowing a plea filed by one Mahantesh Koujalagi and set aside the charge
