Sec 438 CrPC: Anticipatory Bail Plea is Not Maintainable If Accused is Already in Custody in Another Case, Rules Allahabad HC

Recently, The Allahabad HC ruled that, anticipatory bail is not maintainable where accused is already in custody in another case. The bench of Justice Samit Gopal was dealing with the anticipatory bail application filed under Section 438 Cr.P.C. seeking anticipatory bail in the case crime registered under Sections 120B r/w 420, 467, 468, 471 I.P.C.
