Recently Allahabad HC ruled that prosecution sanction are required even if police officials exceed authority in the discharge of official duty. The bench of Justice Dinesh Kumar Singh stated that “if there is no reasonable relationship with the official/public duty the protection under Section 197 CrPC will not be available to such a public servant.”
