SC Refuses To Entertain A Plea Seeking Regulation Regarding Alcoholic Drinks; Calls It A Policy Matter.

Recently, the Supreme Court refused to entertain a plea filed by advocate Ashwini Upadhyay seeking to regulate/prohibit the production, distribution and consumption of intoxicating drinks in Delhi.

At the outset, the Bench of CJI UU Lalit and Justices Ravindra Bhat and Indira Banerjee noted that the issue raised is related to policy making and is not something that the court can adjudge.

However, Mr Upadhyay submitted that he is seeking a limited relief that there should be mandatory warning labels on alcoholic drinks the same way there are warning labels on cigarette packets.

The Bench, however, was not convinced with the submissions and asked the petitioner to withdraw the plea or they will dismiss it and reiterated that it is a policy matter.

After this, Mr Upadhyay sought the court’s permission to withdraw the plea and approach the Law Commission but the court did not grant liberty to approach the law commission but gave liberty to withdraw the plea.
