The order was passed by a vacation Bench comprising Hon’ble Justice DY Chnadrachud and Hon’ble Justice Indira Banerjee.
In a short hearing that was held on Monday, Justice DY Chandrachud had remarked that preservation of life was more important during the pandemic than the celebration of festivals.
Advocate Siddharth Bhatnagar who was representing the Petitioner submitted that there was no empirical data to show that there was a necessity to ban firecrackers. To this contention, the Court stated that any step that can improve the life of Senior Citizens and people with comorbidities should be encouraged.
Advocate Bhatnagar also made an alternate submission wherein he urged the Court to lift the ban during other upcoming festivals like Chhath Puja, Kali Puja and Durga Puja etc.
This request was also declined by the Court on the ground that these festivals were also widely celebrated in West Bengal.
Accordingly, the petition was dismissed by the Court.
