In a major legal twist exactly two years after the devastating Pune Porsche crash, the mother of the accused juvenile driver has moved a special court to demand the forensic and viscera reports of the two victims who lost their lives in the tragedy.
The mother, who herself faces serious charges for allegedly swapping her own blood samples to cover up her minor son’s intoxication, filed the application as the court prepares to frame charges in the case.
A Critical Legal Challenge Before Charges are Framed
In an application filed under Section 207 of the Code of Criminal Procedure (CrPC), the accused woman—who is currently out on bail—argued that the prosecution has failed to provide her with the crucial blood and viscera reports of the deceased victims, Ashwini Costa and Anish Awadhiya.
According to her plea, withholding these documents at this stage violates legal mandates and threatens the integrity of the upcoming trial.
“The matter is currently posted for order as to framing of charges,” the plea states. “Unless there is a compliance with the mandate under section 207 of CrPC, the entire trial of the accused will be vitiated.”
The mother’s defense team has formally prayed for the court to direct the prosecution to immediately hand over copies of the conclusive forensic analysis of both the blood and viscera reports of the two victims.
The Alleged Blood-Swapping Conspiracy
The applicant is among 10 individuals arrested in connection with a highly coordinated cover-up attempt following the crash.
According to investigators, the juvenile’s blood samples were taken to Sassoon General Hospital after the accident. However, to conceal that the 17-year-old was driving under the influence of alcohol, his blood samples were allegedly replaced with those of his mother.
Police allege this swap was facilitated with the direct assistance of two doctors at the hospital. The blood samples of two of the minor’s friends, who were also inside the Porsche at the time of the crash, were allegedly swapped as well.
Background of the Case
The high-profile incident occurred on May 19, 2024, in Pune’s Kalyaninagar area.
Anish Awadhiya and Ashwini Costa were riding a motorcycle when they were fatally knocked down by a speeding Porsche. The luxury vehicle was allegedly driven by the 17-year-old juvenile in an inebriated state.
The case, which sparked nationwide outrage over juvenile driving laws and systemic corruption, now hinges on the special court’s upcoming decision regarding the framing of charges and this latest procedural challenge from the defense.
