The Delhi High Court has ruled that in mere pendency of insolvency petition u.s 9 is not a bar to appointing arbitrator. The Bench of Justice Sanjeev Sachdeva ruled that merely because an insolvency plea is pending it can’t be an embargo on courts to decide arbitration applications.
