“Not Applying Sindoor by Wife Amounts to Cruelty Towards Husband”: Family Court

Indore: In a significant judgment, the Indore Family Court has ruled that a wife’s refusal to apply sindoor, as per Hindu marital traditions, constitutes cruelty towards her husband. This decision was made following a marital dispute brought before the court, emphasizing the significance of traditional customs in contemporary relationships.

The case in question involved a wife who had been living separately from her husband for the past five years without any explicit reason. The husband, seeking reconciliation, petitioned the court under Section 9 of the Hindu Marriage Act, aimed at restoring conjugal rights.

During the proceedings, the wife failed to provide a satisfactory reason for her separation or for not adhering to the traditional practice of applying sindoor. She also accused her husband of demanding dowry, substance abuse, and harassment. However, after considering all arguments, the court ordered the wife to return to her husband, citing a lack of evidence against the husband’s claims.
