No Prior Sanction U/s 17A of PC Act Required Where FIR Registered After Recovery Made From Public Servant: HP HC

In a recent decision, the High Court of Himachal Pradesh addressed the issue of whether prior approval is required for conducting an investigation under the Prevention of Corruption Act, 1988.  The case, involved a Motor Vehicle Inspector (MVI) who sought the quashing of an FIR registered against him by the State Vigilance and Anti-Corruption Bureau.
